I get a phone call from one of my co-workers this morning,said that early sat morning some one tried to break into his garage,to steal something prob one of his bikes,anyway-he heard the noise about 2am grabbed his 357 opened the inside garage door saw the ass-yells at him WTF you stay right there-the guy tried to leave

Yes held him there until the police got there from what he told me from the jail the cops pointed there guns at him and told him to drop it or they would fire,after they put my friend in cuffs then they talked to him -but still arrested him,its like you have know rights to protect yourself or your belongings anymore-his house stayed wide open until my other friends and i got there to board up his garage and lock up his house,to me its crap.

They were doing their job as trained. If there was any fault, it was your friend's for not knowing what to expect when the LEO's arrived, after a possible shooting. They are trained NOT to be onthespot judge and jury, or read minds, or jump to conclusions as to what happened. They are trained to preserve their own safety, so that they do not get killed or seriously injured, and can fulfill their mission. So, if your friend had his firearm out, and at the ready when they arrived, [but he did not have the perp face down and controlled by the threat of an unseen group of weapons, including the nearest large garden implement], his first mistake was not to have placed the firearm on the ground, outside the garage, way away from the controlled perp, just prior to the sirens becoming LOUD. His second mistake [dollars to donuts] was probably not facing the arriving LEO's with his hands in the air.
{Sermon now well engaged} Lawfully carrying a firearm or possesing one even in your home[castle in some states] carries with it a responsibility to be fully trained and fully EDUCATED for your own good. Part of the education is knowing what to expect when the LEOs arrive after being dispatched on a possible serious XYZ event. If you DO know what to expect, you will be much better prepared to act in a manner that will impress the LEO's that you are a good guy, and are willing to cooperate without problems. I am assuming your friend did not have any witnesses to the event. I am not giving legal advice, but, in such an instance, you might consider a brief statement at the scene, in order to avoid your being taken to the station. This should be done only after asking the OIC if he has any intention of charging you with a crime or arresting you. If the OIC indicates he will not do that, a brief statement is in order. But if the OIC says he must arrest to comply with local ordinances [like "brandishment"], your response should be calm and courteous, and you should tell the OIC that you certainly understand His/Her position, and must therefore respectfully invoke your right to remain sillent and request the presence of an attorney.

If you actually had to shoot to stop the perp from using deadly force on you, what I suggested above should be "IN SPADES"

This is the trend in NY, California- Non judgemental policing. There is no difference between your friend and the criminal. In the Peoples Republic of New York you need to allow the criminal to take whatever he wants while you call the cops. Only way to defend yourself is if you can prove your life was in danger. Whether the criminal kills you or you kill the criminal- the net loss is one life. The state makes no determination between the criminals life or yours. 1 net life either way. Property- no value at all.

That is a good point, but I do not like the police being forced to not use common sense. They knew who the aggressor was becuase he was breaking into a home. They know the home owner lives in his home and needs to defend himself.
Investigate, take my gun until the investigation but do not arrest me, cost me everything I own in legal fees and the get me fired from my job because the criminal broke into my house. You can not determine what the criminal wants. Is he armed? Is he high, peaceful and looking for a place to sleep? Is he a child molestor looking to grad my kids?
How can I judge that? These are real examples from the newspaper. I am not saying shoot first, I am saying grab your gun, warn the intruder call the cops stay put and secure your family from the threat.
But do not arrest me for defending against a percieved threat.
What cha think?

My bud is out of jail -now get this,he gets a phone call from the D.A,s office telling him that the assailant that broke into his garage-now needs therapy-every time he even here's a loud noise it makes him jump-so they want my friend to pay for the therapy - and they took and kept his gun because he didn't register it for the last five years,and he has to pay a fine for discharging his weapon in a public neighborhood,tell me cal is not screwed up!!not including he has to tell his home owners insurance co.about the hole in the garage-the patched,i will keep you posted on this one!!

As absurd as this sounds, this is just the beginning. I feel that if a person, no matter what reason they have, breaks into my house, they had better be ready to meet God, because I am gonna send them on a one way trip to see Him. I will defend my property with whatever force is necesary to keep my family safe and secure. If that is against the law, then call me a freaking criminal.

These panty assed liberals should have to deal with a situation such as this so that they could appreciate the importance of the right to defend yourself, but of course, they won't ever be put into this position because they live in gated communities that won't let the bad guys in. Ahhhnold Swarthy-neger, Ted Kennedy, Obama, Pellosi or that puke in New York will never see a break-in at their compound, because the criminals are stopped at the front gates. They depend on the "hired help" to protect them. They all have their "boys" to take up their light work. The only one taking up MY light work is ME. Jack010103, you are right. This is f'ing insane, and it would be funny, except that the joke is on all of us. It is truly a sad day when a person get arrested for doing the right thing. Could you imagine what would have happened had that dude went ahead and took the kill shot? Or even just winged the perp. Those LEO's would have took him out. That is f'ed up! But it isn't a surprise. Get ready people and hold tight to those weapons or they are gonna take them from us.
