Here's the Background of the situation, on Jan 5th 2009 I engaged in a contract to buy my first Handgun, I went to the new Chico Gunstore called Action Shooting (hunting and Sporting goods) it's the new Store on the Esplanade right next to Aftershock Performance, actually the owner, owns Aftershock, the Party store and the gun shop. Anyways, I wanted to buy a Springfield XD .40 Black Service Model 4 inch. (it's just a nice gun that goes bang bang for those who do not know what all that jargon means) anyways, 607.00 was the total cost, I agreed to sign a contract to be able to pay off my gun which was to my understanding being held on layaway, At the time they had more than 1 XD, anyways to jump ahead, I made consistent payments until 4/10/09 when I paid it off in full, only to find out that they did not have my gun anymore and had sold it, had no idea when they would ever be getting one in, (some english/british dude named Steve said it could be 5 months to a year. WHAT THE HELL?

So I took this all up with the owner Scott, he handled things nice with me, saying that I was first on the list to get one, that his underling henchmen didn't know what they were talking about and it would not be too long. After waiting over 10 days, I started to worry about this situation, any began calling to get a hold of Scott, I called for 5 days without so much as a response, until I decided to drive down there. When I asked where Scott was, I got the same story as usual, "Oh he left for the day" until his co-owner/GF let me know he was in the back bay, ok, so I went to talk to Scott, I did find him in the back bay, and it was interesting that the first words out of this man, were defensive as hell, and maybe I'm wrong but after being in EMS for over 3 years and an EMT for 5 years, I have to be able to read people really damn good, he was pissed, defensive, and quick to make any excuse he could, he told me that Springfield is on back order, he kept bringing up the point that he had called me in January and said that he had my gun, but had another buyer and could he sell my gun, at the time i was around Jan 18th when I was out on Medical leave for a back injury and was at Enloe promp care when he called, I said yes, because I was financially screwed for a bit, and did not want to be greedy and hold on to something that I could not pay off right there and then. I just said, can you get one in to replace this one, and was told yes, it wasn't a problem. Scott kept throwing this story at me like leverage of guilt that I had created my problem, as it turns out, per Scott, the gun he was speaking of, wasn't even mine, it was a 2 tone Stainless Steel and Black xd .40, he asked me if it was ok to sell a handgun that was not even mine, they had sold my handgun out from underneath me much earlier and had never called and asked me anything. So after 30 or so minutes of listening to thise dude go off, I asked him, so Scott are you going to give me a refund, and he said no, that there would be store credit. And the thing is in the contract if for any reason I want a refund there would be a 35% restocking fee. I said, I am not returning anything, you have failed to produce the product, you cannot charge money on what isn't there. So as a desperate attempt he gives me this alternative, and this is fucking rich, listen to this, he wanted me to find my gun at another store (shell out another 600 bucks) have it transferred to him (which is another 45 dollar fee) and then he would refund my money. My response, to this, "Ok Scott since I listened to your idea, let me stand back and put this into perspective, 'If I knew that this is how this was going to go, Why in the Fuck would I have ever done business with you?' 'Do you know how stupid that sounds?' This is how I see it, you have failed to produce a product, have sold my comodity, Arbitrating against your own contract which makes it null in void, so your just holding onto my money and are not giving it back, and are trying to trap me into this, Im sorry thats being a thief, that's stealing and I DO NOT RESPECT THAT." then I said, My best suggestion is that you get my gun real damn fast or have a full refund to me. Maybe it was the fact that I was not some push over person, or that I called him a thief, or that I was starting to use legal language which was hinting him to the fact that I may sue, your damn right, I planned to Sue the shit out of this dude, If he would not corgially handle this business, but then again maybe it was hinted that I had my Digital Voice Recorder working hard in my pocket recording every bit of this douche bag contradicting himself (approx 1hr 14 mins of it), oh man, he would had not have been able to stand up for 1 minute in court, the judge would have proabably asked him, "Are you Retarded or something, do you normally do this to your customers?" So anyways, I got him to finally say, let me do this, give me till Monday by monday you will have your gun or your full money back, I gave him a little trust and said ok. Come monday there was no call, to me, man this guy cant keep his word, so I finally heard from him on tues around 5 pm, He said come bye and I will have your money for you. On Wed I did, he gave me a full refund, too much at first, had to have the amount corrected, "I dont want to be accused of stealing from him, no matter how much I could have possibly deserved the extra cash for this punk wasting my time, I dont steal.

The best Part is that he had kept saying that there were no XD's around, none that he could find when he dilligently looks for them on his computer at night, and his reps were out there looking for him. I found 3 XD's on the internet that same day, and found physically 2 in Sacramento, and 2 in Redding. So on thurs I drove to Redding to Old West Gun and Loan and purchased a even nicer New Springfield XD .40 4 inch Service Model Black with Trijicon Night sights for a total cost of 668.00 I have been DROS'ing (Dealer Record of Sale) CA 10 day waiting period since April 30th, I go back to Redding to Pick it up on the 11th after Momma's day (which is on the 10th thats Sunday if you forget) Yah Scott Real Frackin hard to find those handguns, Elusive little Critters aren't they, only took me two hrs to bag mine. So yah If you intend to do business with those guys, just think of my story, Im not trying to Slander the guy, just call it as it see it, or in my case the shit I went trough.

That store doesn't understand the decade old concept of "layaway". You are one patient man! All in all this was a learning experience - never set foot in Action Shooting again - and tell all your pals this story.

This is the kind of mind fuck that gets my heart pounding, I went thru a similar deal for an accessory for my Sig. This was thru Ammo Bro. A deal that should have only taken 5-7 days, took almost 6 weeks and they gave me an attitude. I didn't say a lot until I got my product. After having the part in my hand I blasted the place (verbally) and ended up having a very apologetic conversation with the manager when I want a number for the owner.
