A Tucson, Ariz., SWAT team defends shooting an Iraq War veteran 60 times during a drug raid, although it declines to say whether it found any drugs in the house and has had to retract its claim that the veteran shot first.

And the Pima County sheriff scolded the media for “questioning the legality” of the shooting.

Jose Guerena, 26, died the morning of May 5. He was asleep in his Tucson home after working a night shift at the Asarco copper mine when his wife, Vanessa, saw the armed SWAT team outside her youngest son’s bedroom window.

Guerena grabbed his assault rifle and was pointing it at the SWAT team, which was trying to serve a narcotics search warrant as part of a multi-house drug crackdown, when the team broke down the door. At first the Pima County Sheriff’s Office said that Guerena fired first, but on Wednesday officials backtracked and said he had not. “The safety was on and he could not fire,” according to the sheriff’s statement.

SWAT team members fired 71 times and hit Guerena 60 times, police said.

A report by ABC News affiliate KGUN found that more than an hour had passed before the SWAT team let the paramedics work on Guerena. By then he was dead.

I'm thinking someone should be kissing their retirement bye bye....

Ya'll out there in AZ should be really pushing to have this not only investigated but having it done Openly and Publicly.

sounds like somthing that would happen in my town.this shit makes me sad and angry.sad the cops cant do the correct recon to make sure they are serving the right house.sad because even if they were serving the right house,ANYONE who is woke to a bunch of swat ninja type folks coming in the house isnt gona be thinking rationaly enough to first think police...I KNOW I WOULDNT BE.angry because cops always blame it on their victims,always have some good reason why they excessively shot some poor bastard to death.these fuckin dicks didnt even allow him treatment.THATS SUPOSED TO BE NUMBER ONE PRIORITY AFTER SECURING THE HOUSE,AND CHECKING THE SUSPECT FOR WEAPONS AND DRUGS ISNT IT?every cop involved should face manslaughter charges if you ask me.no retirement no severance nothing...just jail like the rest of us would get!hope his family sues the state broke!

I know I would request that they would do so and run their own investigation into it. He pulled two tours in Afghanistan, served honorably and probably had Inactive Reserve status making him still connected so they could send NCIS there without special permission.

His weapon was on Safe, he was a combat veteran who had just spent two years doing entries and kicking up dust pounding ground. He did not forget his training and remove the weapon from a safe state without knowing what was going on and who was on the other side. He was shot and killed instantly without: 1, deciding there was a threat he needed to fire upon 2, giving him the ability to lower his weapon

They can try and paint it as they like but they have already been caught out lying about how he fired first. They never found a thing in his home indicating he had any connection to any drugs or anything else illegal for that matter. They also think that they can brow beat the news media into not talking about it.

Sounds to me like this is definitely something that should put some into jail, others out of law enforcement forever and all of the connected to it should be vilified as publicly as possible to the point that every single person they run into knows who they are.

thats pretty much what i think.im sick of dirty/overzealous/ignorant cops diong this kind of bullshit.cops should be held to an even higher legal standard than civilians because they represent the law.in addition to whatever charges for his death,they need to face charges of neglegence(for not geting him treatment) possibly falsifying evedence for lying about him shooting first,and not sure what youd call it (obstructing the media) somthing to that effect anyway.

Abuse of power

I hesitate to bad mouth law enforcement because, all-in-all, most are good guys doing a job and aren't self important or power hungry. But there are always exceptions. And this does seem to be one of those cases where they stepped over the line and need to be held accountable.
If their IA is unwilling to do this or the DA, then the public should show their outrage and force their hand.
