Question for gunslot. Your answer may vary by state
Last week a 20 year old walked into an apartment of a 75 year old at 3:00 am in my county. 75 year old wakes up, gets his gun and confronts the 20 year old. They tussle and the 75 year old pushes the 20 something out the door. As the 20 year old runs away the 75 year old shoots him 4 times, in the back. The kid dies. He has been charged with 2nd degree manslaughter. Debate ensues. What's the law in your state. Can Wallace, the 75 year old, get off on self defense? A 20 yr old vs a 75 year old. The 20 yr old can come back and seek revenge and cause peril of death. It is a righteous shooting here in Arizona.
You just need to move off of that Liberal Island where even your churches and pastors are a threat to your wives and daughters. Just read that book on the Assemblies of God Pastor Nick Hacheney (sp) in late 90s early 2000s.

but "the Island" is attached to Kitsap County, which is much more down to earth, except it's controlled by the Democratic machine. The shooting happened in Port Orchard south of me, which is a blue collar area. You;d think a Navy town would be more conservative, but the shadow of Seattle is just too damned close. Thanks for the info.

will be viewed as malicious intent rather than self defense.
Repeat, It don't look good.

Guy is out on bail at the moment. he may have done himself in by talking to the cops when he should have shut up and got a lawyer. NEVER talk to the cops if there's the remotest possibility you would be charged. I got some personal experience with this.

Clinton pardoned terrorists and Obama has friends who are terrorists, that this guy should be given a pass, especially at 75...but we live in the greatest nation on earth, one that we are fundamentally changing...that's right!

the twenty year old is SOL and the gentleman that defended his property and his life is not at fault

I know it isn't supposed too, but we all know the DA either knew the kid by name or not.
If not, gonna be a tough battle.

I don't know the law here in Utah. I'll check, both out of curiosity in this case, and to find out what I should do if the situation ever arises.
I've always operated on the premise that if someone is fleeing, especially with their back to you, there is no imminent threat, and you have no legal right to shoot them.
