Now if she would have been armed properly what do you think the results would have been?
David Flavell, 40, was arrested Thursday and accused of assaulting a 27-year-old hospital employee in a bathroom in the hospital lobby shortly before 4 p.m. Thursday. He claims he had been drinking and has no memory of the crime.
He was arraigned in Boston Municipal Court on charges of assault with intent to rape and assault and battery by means of a dangerous weapon and ordered held without bail pending a court evaluation.
Prosecutors said that they'd seek a dangerousness hearing to have Flavell held until his trial.
"It was a brazen attack and a very violent attack," Suffolk County District Attorney Daniel F. Conley said. "We’re using every tool at our disposal to keep this man off the streets."
The hospital said Flavell was a trespasser in the building. The victim was injured but was treated and released, police said.
"That in no way diminishes the violence of this attack or the terror she endured," Conley said. "This was extremely serious and she put up a very strong fight."
Police said Flavell has a record that includes more than a dozen sex crime charges including an attempted rape inside a bookstore in Braintree last year.
In that incident, police said Flavell was caught on surveillance cameras as he followed a woman into the store's restroom and tried to block her in. She managed to scream and run for help.
Police said they found duct tape and a ski mask in his backpack.
Flavell has a history of police reports dating back more than a decade and his last arrest sparked outrage over how sex offenders are monitored in Massachusetts.
