(WHAS11) - Two men face manslaughter charges for a home invasion where the third suspected burglar was killed by the homeowner.

A Shelby County grand jury indicted 23-year-old Timothy Carpenter and Joshua Fast on complicity to manslaughter charges Monday.

They'd been in custody on burglary charges since Friday.

Back in October 2008, police say Carpenter, Fast and a third man, David Fletcher, broke into a Shelbyville home.

A resident killed Fletcher in what police call self defense.

Prosecutors say Carpenter and Fast are responsible for his death because it happened as part of a crime.

3 to 1 is always self defence.
Be hard to find a jury of 12 that
dosen't think that way
Only takes one to hang a jury
Better tried by 12
than carried by 6

If I have to take my chances I would rather
shoot and be tried in court than not shoot
and go to the grave yard

In New York State

In NY the 2 survivors would sue the homeowner for stress related injuries and win. The homeowner would be charged with manslaughter and get the max sentence. The dead criminal's family would also sue for lost wages and win. I have see this shit, its not even funny
