TITLE 32 > CHAPTER 1 > § 109

§ 109. Maintenance of other troops

(a) In time of peace, a State, the Commonwealth of Puerto Rico, the District of Columbia, Guam, or the Virgin Islands may maintain no troops other than those of its National Guard and defense forces authorized by subsection (c).

(b) Nothing in this title limits the right of a State, the Commonwealth of Puerto Rico, the District of Columbia, Guam, or the Virgin Islands to use its National Guard or its defense forces authorized by subsection (c) within its borders in time of peace, or prevents it from organizing and maintaining police or constabulary.

(c) In addition to its National Guard, if any, a State, the Commonwealth of Puerto Rico, the District of Columbia, Guam, or the Virgin Islands may, as provided by its laws, organize and maintain defense forces. A defense force established under this section may be used within the jurisdiction concerned, as its chief executive (or commanding general in the case of the District of Columbia) considers necessary, but it may not be called, ordered, or drafted into the armed forces.

(d) A member of a defense force established under subsection (c) is not, because of that membership, exempt from service in the armed forces, nor is he entitled to pay, allowances, subsistence, transportation, or medical care or treatment, from funds of the United States.
(e) A person may not become a member of a defense force established under subsection (c) if he is a member of a reserve component of the armed forces. .

Got the right of a State to maintain.. Is that your point, or the obvious duplicitus wording (spell check busted gents sorry)..

My current issue is with foriegn aid (a little voice in my head ((Adam those pills pls)) is saying don't attempt this with out working spell check) I hate the fact that were sending Billions, perhaps trillions of bucks overseas to Nations that hate us,and will not vote with us in the UN.. What makes matters worse is in "many" cases were not giving that as humanitarian aid, but directly to corrupt governments, that the people don't support. Consequently the people hate us, no good comes from those monies.. and to say its "needed" here at home is so simplistic it sounds moranic.. OK obviously im on a rant.. and sure with i had a spell check, guys look past my spelling at the reality of whats going on.. Were underfunding NASA to the poiint that we have to "hitch a ride" with Red land.. We have our own starving kids.. I don't mind this money going over to drill wells for clean water, or for food, but it's not. BILLIONS and BILLIONS wasted going in back pockets to heads of states of Nations that hate us.. Shessh wheres Lyle when ya need him..feel a_____________ coming on.. Ok.. Greg .. put down the computer.. step away from the computer Mr Edwards.. thats right sir... come with me and sit down for a bit..sheeesh

Jan Brewer Gov of AZ can start a civilian security force and we can go to the border to defend it.
I think we could train, build pill boxes and take out the drug smugglers and herd the poor unwashed masses back across the border.

i had yep A makes it clear you can only have a natl guard B lets you use it.. When i reread it, all that changed.. Yes C makes it clear you can have what ever defense force the state wants.

I always thought that a State had a right to protect and defend it's self!! Hell sakes, what Arizona is goin through, they need to plug the holes 30 years ago!! Oklahoma has an air Ntl. Guard. Allstates have the Guard of some kind. wouldn't it be legal for the Govenor to put in place, these means of defence, against an invading problem??? Isn't the Govenor, the President of the State (so to speak)????
A disaster strikes, who comes to the front?? The Mayor, Chief of police, Shariff, Lets just say all the First Responders. That would include, The National Guard, with the Govenor in charge of them??? Remember Katrina??? what a big Cluster Fuck that was, NO one in Charge!!
My thoughts, on Arizona,________________let the Govenor and Law Enforcement do their job, that the Feds. won't do. I think Texas would back up Az. Don't know about Kali.
If I'm wrong, or my thinking is off, strighten me out!!
Feds, Government, polititions ain't got the BALLS to call it like it is! They can't answer a simple question. They skirt around the issue. Give lip service and chip teeth, and you ask your self_______________-what the f&$k did he just say????
All they want is their jobs!!! Sit on their ass, get fat, vote themselves a raise!! WTF?????
I'll stop, might need to hit the blood pressure bottle!!!
If the Feds. won't plug the hole in the dam, then its up to the Govenor to send the workers to seal the hole in the damn dam. Or we'r all gonna take a sok'in!!!!

Ditto, I think

that the States retain more power than people give them credit for, like Lyle stated, the Governor of any State has the power to call out the National Guard in times of emergency without permission from the Fed.
